Sunny Seed Promise Terms of Service
Your Lawn Specialist Friend
Effective upon the customer's acceptance or purchase of qualifying services • Last Updated: October 30, 2026
The Sunny Seed Promise is Golden Green LLC's commitment to stand behind qualifying lawn-care and seeding services. We want our customers to feel confident that we care about the results and will help address reasonable bare spots that remain after seeding. Grass is a living plant. Its successful establishment depends on sunlight, airflow, soil conditions, moisture, temperature, maintenance, and the surrounding environment. Golden Green cannot force grass to grow — or remain healthy — in a habitat that cannot reasonably support turf.
1Eligibility
The Sunny Seed Promise applies only when the customer purchases and completes all of the following qualifying services from Golden Green:
- Golden Green's complete six-step fertilization and weed-control program;
- Fall mechanical core aeration;
- Fall overseeding; and
- Overseeding with Golden Green's Sunny Seed Mix.
The customer's account must remain active and current, and all qualifying services must be completed as recommended and scheduled by Golden Green.
Services purchased separately, partial lawn programs, customer-supplied seed, seeding performed by another company, or properties that do not receive the complete qualifying program are not covered by the Sunny Seed Promise.
2The Sunny Seed Mix
The Sunny Seed Promise applies exclusively to Golden Green's Sunny Seed Mix. Sunny Seed Mix is Golden Green's selected blend of turf-type tall fescue and Kentucky bluegrass. Depending on seasonal conditions, seed availability, or professional judgment, Golden Green may include a small percentage of perennial ryegrass or adjust the cultivars or proportions within the blend. These reasonable adjustments do not invalidate the Sunny Seed Promise.
Golden Green will not substitute a customer-requested shade-seed or fine-fescue mixture under the Sunny Seed Promise. Fine fescue may tolerate certain shaded conditions, but it may develop a less durable root system and may be more easily damaged or pulled out under the conditions commonly found on the properties Golden Green serves.
If a customer requests a different seed mixture, the seeding service may be performed only under separate written terms and will not qualify for the Sunny Seed Promise.
3What the Sunny Seed Promise Provides
If an eligible lawn develops reasonable isolated bare spots or areas where the original seeding did not successfully establish, the customer should contact Golden Green. After evaluating the property, Golden Green will provide reasonable complimentary spot seeding of qualifying areas when:
- The area is capable of supporting turf;
- The customer has followed the required watering and aftercare instructions;
- The area is accessible and safe to service;
- The underlying cause does not require services or materials excluded from the Promise; and
- Weather and seasonal conditions are appropriate for seeding.
Examples may include a bare spot near a mailbox, an isolated thin area in the open lawn, or another reasonable spot that did not take after the qualifying fall aeration and overseeding. Customers should not hesitate to contact us about a reasonable concern. We want to inspect the area, explain what may have happened, and help whenever the site can reasonably support grass.
4Spot Seeding — Not Complete Lawn Reseeding
The Sunny Seed Promise provides spot seeding of reasonable qualifying bare areas. It does not include:
- Reseeding or overseeding the entire lawn;
- Complete lawn renovation;
- Repeated whole-property seeding;
- Sod installation;
- Grading or excavation;
- Topsoil, compost, or soil replacement;
- Drainage correction;
- Tree removal, tree pruning, or root work;
- Removal of buried concrete, stone, construction debris, or other obstructions;
- Removal of existing undesirable grasses or invasive plants;
- Extensive cultivation, tilling, slit seeding, or seedbed reconstruction; or
- Repairs for damage caused after the original service.
If a spot requires topsoil, more intensive cultivation, grading, drainage work, vegetation removal, or another corrective service, Golden Green may recommend that work as an additional paid service. Topsoil is not included in the Sunny Seed Promise.
5Grass Must Have a Suitable Growing Environment
The Sunny Seed Promise applies only where grass can reasonably germinate, establish roots, and remain healthy. Golden Green cannot guarantee grass establishment or survival in an environment that is unsuitable for turf. The Promise does not require Golden Green to continue applying seed to an area where professional evaluation indicates that grass is unlikely to establish or remain healthy.
The following conditions may make turf establishment extremely difficult or impossible:
A. Trees, Dense Shade, and Exposed Roots
Grass may not successfully grow beneath trees, particularly where there is dense or continuous shade; a thick or low tree canopy; extended or exposed surface roots; heavy competition from tree roots for moisture and nutrients; limited airflow; excessive leaf coverage; or soil that cannot be properly cultivated without risking damage to the tree.
A tree that has been properly limbed, permits sunlight and airflow, and does not have extensive exposed roots may provide a better opportunity for grass establishment. However, improved conditions do not create a guarantee. Some properties have shade, compacted soil, and exposed roots in the same area. In those circumstances, establishing sustainable turf may be practically impossible. Golden Green may recommend pruning by a qualified tree professional, mulching, a landscape bed, shade-tolerant non-turf plants, or another alternative instead of repeatedly attempting to grow grass.
Golden Green will not cut, damage, bury, or aggressively cultivate major tree roots to establish turf.
B. Buildings, Algae, Moisture, and Poor Airflow
Areas beside a house, fence, retaining wall, or other structure may receive too little sunlight or airflow to support healthy turf. Visible algae or persistent organic growth on siding, fencing, soil, or nearby surfaces may indicate a damp, shaded, low-airflow environment. If these conditions exist, grass seed may fail even when the seed and application are otherwise appropriate. Golden Green cannot force grass to grow in an area where persistent shade, moisture, poor drainage, or restricted airflow creates an unsuitable habitat.
C. Severe Compaction and Traffic
Grass may fail in soil that is severely or repeatedly compacted. The Sunny Seed Promise does not cover failure caused by vehicles parking or driving on the lawn; repeated foot traffic; construction activity; heavy equipment; delivery traffic; pets repeatedly running or digging in the same area; soil that becomes compacted again after aeration; or any other continuing use that prevents seedlings from establishing.
Mechanical core aeration can improve many compacted lawns, but it cannot always correct severe compaction or an underlying structural problem in a single service.
D. Buried Concrete, Stone, and Construction Debris
Concrete, stone, asphalt, gravel, construction debris, shallow utilities, or inadequate topsoil may be hidden beneath the surface. These conditions can prevent root development, retain or redirect heat and moisture, interfere with cultivation, and make lasting turf establishment impossible without excavation or soil replacement. Investigation, removal, excavation, and topsoil installation are not included in the Sunny Seed Promise.
E. Wooded Edges and Invasive or Undesirable Grasses
The Promise does not cover areas transitioning into woods, unmanaged vegetation, or groundcover where suitable turf conditions do not exist. This includes areas dominated by Japanese stiltgrass, nimblewill, or other invasive, undesirable, or naturally occurring vegetation that competes with the Sunny Seed Mix or indicates that the area is not suitable for conventional lawn turf. Controlling or renovating these areas may require a separate treatment plan, vegetation control, repeated cultivation, soil correction, or landscape conversion.
F. Drainage, Erosion, and Soil Problems
The Promise does not cover seed failure caused by standing water or poor drainage; downspout discharge; runoff or erosion; washouts or flooding; excessively wet or excessively dry soil; inadequate topsoil; severe soil acidity or other unfavorable soil chemistry; contaminated soil; steep slopes; excessive thatch; rock, gravel, or debris near the surface; or conditions requiring grading, drainage work, soil testing, or soil replacement.
Golden Green may recommend a soil test or additional corrective services before further seeding.
6Customer Watering and Aftercare Responsibilities
Seed and young grass require attentive care. The customer is responsible for following all watering and aftercare instructions provided by Golden Green. The customer agrees to:
- Begin watering as instructed after seeding;
- Keep the seedbed consistently moist during germination without causing runoff or standing water;
- Continue appropriate watering as seedlings establish;
- Adjust irrigation for rainfall, temperature, and site conditions;
- Keep leaves and debris from smothering seedlings;
- Limit foot, pet, and vehicle traffic;
- Avoid disturbing or raking out the seed;
- Follow Golden Green's mowing-height and first-mowing instructions;
- Avoid applying products that could interfere with seed germination or damage seedlings; and
- Notify Golden Green promptly if an irrigation problem, washout, erosion event, or other issue occurs.
Failure to water, excessive watering, inconsistent watering, mowing too early or too short, leaf smothering, traffic, customer-applied chemicals, or failure to follow aftercare instructions may make an area ineligible for complimentary spot seeding. Natural rainfall does not necessarily replace the customer's watering responsibility.
7Weather and Seasonal Conditions
Germination and establishment depend on soil temperature, air temperature, rainfall, sunlight, and seasonal timing. Drought, excessive rain, flooding, erosion, unusual heat, early freezing, delayed spring conditions, severe winter weather, disease pressure, wildlife activity, or other circumstances outside Golden Green's control may delay or prevent establishment.
Golden Green may postpone spot seeding until a suitable growing window. A delayed visit based on weather, soil, or seasonal conditions is not a refusal to honor the Promise.
8Reporting a Bare Area
The customer must notify Golden Green promptly after allowing a reasonable period for germination and establishment. The customer should provide:
- Their name and service address;
- A description of the affected location;
- Clear current photographs when requested;
- Information about watering and aftercare; and
- Notice of any traffic, construction, washout, irrigation failure, chemical application, or property change affecting the area.
Golden Green must be given a reasonable opportunity to inspect the property before another company or the customer alters, reseeds, excavates, treats, or repairs the area.
9Inspection and Professional Evaluation
Golden Green may inspect the reported area before approving spot seeding. During the evaluation, Golden Green may consider:
- Sunlight and shade;
- Tree canopy and exposed roots;
- Airflow;
- Soil depth and compaction;
- Moisture and drainage;
- Irrigation coverage;
- Erosion;
- Traffic and property use;
- Customer aftercare;
- Existing weeds or undesirable grasses;
- Buried obstructions; and
- Whether the area can reasonably support the Sunny Seed Mix.
Golden Green will explain its findings and, when practical, recommend steps that may improve the site. If the area cannot reasonably sustain turf, Golden Green may decline additional seeding and recommend a more suitable solution. This decision is not an attempt to back out of the Sunny Seed Promise — it recognizes that adding more seed cannot correct an unsuitable habitat.
10Damage and Changed Conditions
The Promise does not cover bare spots or turf loss caused after service by matters including:
- Customer, tenant, visitor, contractor, or neighbor activity;
- Pets, wildlife, insects, or disease;
- Vehicles or equipment;
- Construction or utility work;
- Snow removal or deicing materials;
- Herbicides or other products not applied by Golden Green;
- Improper mowing;
- Irrigation failure;
- Flooding, erosion, drought, or severe weather;
- Leaf accumulation;
- Newly created shade or drainage conditions; or
- Any material change to the property.
Golden Green may offer repair of these areas as an additional paid service.
11No Promise of Perfection
The Sunny Seed Promise is intended to produce meaningful improvement — not a perfectly uniform lawn. Natural variation in germination, color, density, texture, and maturity is normal. Seedlings may establish at different rates, and some areas may require more time to fill in. The Promise is not a guarantee that every seed will germinate, every portion of the property will support turf, or the lawn will remain free of weeds, disease, insects, damage, or future bare spots.
12Reasonable Remedy
For an approved claim, Golden Green's obligation is limited to reasonable spot seeding with the Sunny Seed Mix during an appropriate growing window. Golden Green will determine the suitable seed quantity, preparation, timing, equipment, and application method based on its professional judgment.
The Promise does not provide a cash refund, account credit, reimbursement for another contractor, replacement with sod, or payment for landscaping or property alterations.
13Customer Cooperation
The Sunny Seed Promise works when Golden Green and the customer each do their part. Golden Green agrees to provide qualifying services professionally, evaluate reasonable concerns honestly, communicate transparently, and return to spot-seed eligible areas when appropriate.
The customer agrees to provide proper watering and aftercare, protect newly seeded areas, disclose relevant site conditions, allow reasonable access, and address environmental or structural problems that seeding alone cannot correct.
14Acceptance
By purchasing, scheduling, or receiving qualifying services under the Sunny Seed Promise, the customer acknowledges that:
- Grass is a living plant whose establishment cannot be forced;
- Environmental and property conditions affect germination and survival;
- The Promise applies only to Golden Green's Sunny Seed Mix;
- The Promise provides reasonable spot seeding, not complete lawn reseeding or renovation;
- Topsoil and other corrective work are not included;
- The customer must follow watering and aftercare instructions; and
- Golden Green may decline repeated seeding where the site cannot reasonably support turf.
The customer confirms that they have read, understood, and agreed to these Sunny Seed Promise Terms of Service.
